Drug Court
Special Prosecution Unit


One of the ways that the Madison County State's Attorney's Office works to combat the serious problem of drug use is to aid those facing criminal drug charges in their rehabilitation through "drug court." The special prosecution program replaces prosecution and a sentence with treatment and counseling. The idea is to divert non-violent drug users away from a criminal record and toward treatment that will rid them of drug problems while offering career counseling.

When a defendant enrolls in the program, prosecutors will drop the criminal charges upon completion of the program. In exchange, the participants must allow a comprehensive assessment of their drug or alcohol problems, and then attend treatment for about a year. They will attend group and individual sessions with counselors, and must report regularly to court for reviews of their progress.

The success of the drug court program has been overwhelming. Not only has it helped hundreds of people in their recovery, but it also has taken the burden off of a legal system that has historically seen a drastic rise in the number of drug-related crimes. Drug court has also helped in reducing the number of related crimes since offenders often commit crimes to help feed their drug habits.
